Her tombstone list her first name as Fanny. I have seen infomation that stated that Frances was born in Virginia. However I think Frances was born in Rutherford Co., NC because at the time of 1790 Census Frances' father and his family were already living in Rutherford Co.

Frances Davenport Lynch will probated in Rutherford Co., NC in 1887:
I, Frances Lynch, of Green hill Township, Rutherford Co., N.C. do make, publish and declare this my last will and testament.

1st- I give my niece, Lucendia J. Dalton (daughter of sister Elizabeth), on good bedstead, bed and now clothing belonging to it. Also my side saddle, and all my wearing clothes, she is not to be held accountable for any money or monies that she may have received from me, but the same as a gift

2nd - I give to the each of my three sons, E. Madison, Jonathan K. and John the notes and devise of any kind I hold against them respectively and I give to my three sons all the balance of my property, estate and effects to be equally devided between them, but in case they can not agree in reguards to the division, the my execator shall sale in such a way he thinks proper, the property they can not agree to divide, and shall divide the proceeds of the sale between my three sons, the forgoing gifts are absolute with this qualification in respect to what I give my son John to wit, if he should die without having desposed of or consumed what I have given him, or any part thereof, then the same shall go to my sons E. Madison and Jonathan Lynch to be equally devided between them.

I appoint my son E. Madison Lynch execator of this will and testament.

Family history has it that Elias was a cousin of Laxton. However to date no one has established who Elias' parents were. Therefore, they being cousins can not be proved. Elias Linch (Lynch) first showed up on the Rutherford Co. census in 1800. Elias was possible a son of William’s (Laxton’s father) brother Thomas

A Fred Lynch appeared in the 1790 Census for Rutherford Co.. On 1/2/1798 a will for Frederick Lynch was written in Rutherford Co.. It was probated in the April, 1798 Court for Rutherford Co.. In the will a wife named Nanys (Nancy) was listed. A Nancy Linch (Lynch) as head of a household also appeared in 1800 census for Rutherford Co.. I don't know if a family relationship existed between Elias, Frederick, and Nancy. A Federick Lynch was listed as having paid taxes in Brunswick Co, VA on a list of those paying taxes between 1782 and 1787.

The birth and death dates are unreadable on Elias' tombstone.

In the name of God Amen
I, Elias Lynch, calling to mind the uncertainty of life and the certainty of death, do name and ordain this my last Will and Testament, revoking all others.
First I will and bequeath to my beloved wife, Frances, six negroes, two man, two woman and a boy and girl all her choice during her natural life, all the household and kitchen furniture, three horses or mules, her choice, one wagon and gear, three plows with all the necessary tool to carry on her farm, forty head of hogs, six cows and calves. Two other cattle for beef, fifteen head of sheep, if on hand, one set of blacksmith tools, 500 dollars of money, with a sufficient of grain and rufness of all kind to do her and the family one year, together with all necessary to make her comfortable for the same time. The money and stock she may dispose of to suite herself. At her death the negroes to be sold by my Executer and the proceeds equally divided among my legal heirs.
All of my property not otherwise disposed of to be sold at my death and all my children made equal, taking into consideration what I have already advanced or given them as will appear by reference to the book where I have kept their accounts so far.
My daughter, Rebecca Minerva King, being dead, the balance that may be due her I give her children she had by her husband, Noah King, as my account will show that they have already received. My son, Tolivar D. Lynch, being dead and left four children, two sons and two daughters, what may de coming to my two granddaughters, children of Tolivar D. Lynch, I place in the hands of my son, E.M. Lynch, in trust for them and by him to be vested in real estate for their sole benefit, their heirs I mean their estate that may be due them on the final settlement of my estate.
I appoint my son, Elias M. Lynch, sole executer to this my last Will and Testament. In witness where of I have hereof set my hand & seal this 2nd day of July 1858.

A Codicil to my last will and testament being dated the 2nd day of July, 1858.
Being desirous of making a small in the same to wit. All the property or estate that would be due my daughter Malinda (Lynch) Whiteside at my death shall be paid to her six children say Martha (Whiteside) Elliott, Wm., Joseph, Posey, Richard & Noah Whiteside that is they are to have their mothers share of my estate taking into consideration what she has already received in witness where of I have here unto set my hand and seal this 19th day of October 1860.
